Recovering export receivables from a foreign buyer

Jurisdiction clauses, foreign award enforcement and the practical route to getting paid across borders.

Start with the paperwork you already have

Purchase order, proforma and commercial invoice, bill of lading, packing list, inspection certificate and the buyer's written confirmations. Cross-border recovery is won on documentary completeness far more than on argument.

Amicable demand through local counsel

A demand letter that arrives on the letterhead of a lawyer in the buyer's own city, in the local language, carries more weight than one posted from India. We coordinate that correspondence and keep a single line of reporting to you.

Arbitration is usually the better clause

India and most trading nations are parties to the New York Convention, so an arbitral award is generally easier to enforce abroad than a court decree. A foreign court judgment from a non-reciprocating territory requires a fresh suit in India under Section 13 of the CPC.

Compliance while you recover

Keep the export realisation timeline and the write-off and extension procedures in view with your authorised dealer bank, and document each recovery step so the regulatory position stays clean while the dispute runs.
